Welcome to DayOf ("we," "us," or "our"). These Terms of Use govern your access to and use of the DayOf platform, including our website, marketplace, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Terms
You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information when creating an account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Booking & Reservations
DayOf facilitates bookings between attendees and local businesses. All bookings are subject to availability and confirmation by the respective service provider. Pricing, cancellation policies, and refund terms are set by individual providers and displayed at the time of booking. DayOf is not a party to the transaction between you and the service provider.
5. Intellectual Property
All content, trademarks, and other intellectual property on the Service are owned by DayOf or its licensors. You may not reproduce, distribute, or create derivative works from any content on the Service without our prior written consent.
6. Limitation of Liability
To the fullest extent permitted by law, DayOf shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability shall not exceed the amounts paid by you, if any, to DayOf during the twelve months preceding the claim.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
8. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
